II.<\/p>\n

\u00a0<\/p>\n

1. V\u011bcn\u00e1 b\u0159emena jsou z\u0159izov\u00e1na povinn\u00fdm z v\u011bcn\u00fdch b\u0159emen pro vlastn\u00edka in\u017een\u00fdrsk\u00fdch s\u00edt\u00ed – \u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026. jako opr\u00e1vn\u011bn\u00e9ho z v\u011bcn\u00fdch b\u0159emen za \u00fa\u010delem provozov\u00e1n\u00ed in\u017een\u00fdrsk\u00fdch s\u00edt\u00ed.\u00a0 Touto smlouvou se z\u0159izuj\u00ed pr\u00e1va odpov\u00eddaj\u00edc\u00ed v\u011bcn\u00fdm b\u0159emen\u016fm, a to:<\/p>\n

a) pr\u00e1vo vstupu na Pozemky, ch\u016fze a j\u00edzdy a pro vlastn\u00edka in\u017een\u00fdrsk\u00fdch s\u00edt\u00ed specifikovan\u00fdch v \u010dl\u00e1nku I. bodech 2. a 3. t\u00e9to smlouvy jako opr\u00e1vn\u011bn\u00e9ho z v\u011bcn\u00fdch b\u0159emen, a v souvislosti s v\u00fdkonem jeho vlastnick\u00fdch pr\u00e1v a povinnost\u00ed i pro t\u0159et\u00ed osoby<\/p>\n

b) pr\u00e1vo z\u0159\u00edzen\u00ed, ulo\u017een\u00ed a provozov\u00e1n\u00ed in\u017een\u00fdrsk\u00fdch s\u00edt\u00ed a povinnost prov\u00e1d\u011bn\u00ed spr\u00e1vy, \u00fadr\u017eby, oprav a \u00faprav p\u0159edm\u011btu v\u011bcn\u00fdch b\u0159emen jak opr\u00e1vn\u011bn\u00fdm z v\u011bcn\u00fdch b\u0159emen, tak v nezbytn\u00e9m rozsahu i t\u0159et\u00edmi osobami<\/p>\n

c) povinnost opr\u00e1vn\u011bn\u00e9ho uv\u00e9st po proveden\u00fdch \u010dinnostech na sv\u00e9 n\u00e1klady Pozemky do p\u016fvodn\u00edho stavu.<\/p>\n

\u00a0<\/p>\n

2. Opr\u00e1vn\u011bn\u00fd pr\u00e1va odpov\u00eddaj\u00edc\u00ed v\u011bcn\u00fdm b\u0159emen\u016fm v\u00a0rozsahu uveden\u00e9m v\u00fd\u0161e p\u0159ij\u00edm\u00e1 a naopak povinn\u00fd se zavazuje\u00a0 tato pr\u00e1va\u00a0 strp\u011bt.<\/p>\n

\u00a0<\/p>\n

3. Opr\u00e1vn\u011bn\u00fd se zavazuje, \u017ee p\u0159i realizaci pr\u00e1v odpov\u00eddaj\u00edc\u00edch v\u011bcn\u00fdm b\u0159emen\u016fm v rozsahu uveden\u00e9m v\u00fd\u0161e bude \u0161et\u0159it pr\u00e1va povinn\u00e9ho z v\u011bcn\u00fdch b\u0159emen.<\/p>\n

\u00a0<\/p>\n

4. Ve\u0161ker\u00e9 \u0161kody, kter\u00e9 by vznikly povinn\u00e9mu nebo t\u0159et\u00edm osob\u00e1m p\u0159i realizaci pr\u00e1v z\u00a0v\u011bcn\u00fdch b\u0159emen opr\u00e1vn\u011bn\u00fdm nebo j\u00edm pov\u011b\u0159en\u00fdmi t\u0159et\u00edmi osobami, jdou pln\u011b k\u00a0t\u00ed\u017ei opr\u00e1vn\u011bn\u00e9ho.<\/p>\n

\u00a0<\/p>\n

5. Pr\u00e1va odpov\u00eddaj\u00edc\u00ed v\u011bcn\u00fdm b\u0159emen\u016fm specifikovan\u00e1 v bodu 1. tohoto \u010dl\u00e1nku t\u00e9to smlouvy z\u0159izuje povinn\u00fd jako z\u00e1vazn\u00e1 po dobu existence in\u017een\u00fdrsk\u00fdch s\u00edt\u00ed specifikovan\u00fdch v \u010dl\u00e1nku I., bodech 2. a3. a zavazuje se tato pr\u00e1va strp\u011bt, a opr\u00e1vn\u011bn\u00fd tato pr\u00e1va, odpov\u00eddaj\u00edc\u00ed v\u011bcn\u00fdm b\u0159emen\u016fm, v\u010detn\u011b povinnost\u00ed specifikovan\u00fdch v t\u00e9to smlouv\u011b p\u0159ij\u00edm\u00e1. Z\u00e1nikem p\u0159edm\u011btn\u00fdch in\u017een\u00fdrsk\u00fdch s\u00edt\u00ed zanikaj\u00ed p\u0159\u00edslu\u0161n\u00e1 v\u011bcn\u00e1 b\u0159emena, a to i jednotliv\u011b.<\/p>\n

\u00a0<\/p>\n

III.<\/p>\n

\u00a0<\/p>\n

1. Smluvn\u00ed strany se dohodly, \u017ee smlouva o v\u011bcn\u00fdch b\u0159emenech je uzav\u0159ena a sjednan\u00e1 jednor\u00e1zov\u00e1 finan\u010dn\u00ed n\u00e1hrada je stanovena v souladu se Z\u00e1sadami pro uzav\u00edr\u00e1n\u00ed smluv o z\u0159\u00edzen\u00ed v\u011bcn\u00e9ho b\u0159emene p\u0159i budov\u00e1n\u00ed a rekonstrukc\u00edch in\u017een\u00fdrsk\u00fdch s\u00edt\u00ed na pozemc\u00edch ve vlastnictv\u00ed obce \u2026\u2026\u2026\u2026\u2026\u2026.. (d\u00e1le jen cena v\u011bcn\u00fdch b\u0159emen). V\u00fdpo\u010det ceny v\u011bcn\u00fdch b\u0159emen z t\u00e9to smlouvy je uveden v p\u0159\u00edloze \u2026\u2026\u2026\u2026\u2026.. t\u00e9to smlouvy a tvo\u0159\u00ed jej\u00ed ned\u00edlnou sou\u010d\u00e1st. <\/p>\n

\u00a0<\/p>\n

2. Vypracov\u00e1n\u00ed znaleck\u00e9ho posudku na ocen\u011bn\u00ed v\u011bcn\u00fdch b\u0159emen pro pot\u0159eby povinn\u00e9ho zajist\u00ed na sv\u00e9 n\u00e1klady opr\u00e1vn\u011bn\u00fd, s t\u00edm, \u017ee jedno origin\u00e1ln\u00ed par\u00e9 znaleck\u00e9ho posudku je opr\u00e1vn\u011bn\u00fd povinen p\u0159edat povinn\u00e9mu p\u0159i podpisu t\u00e9to smlouvy. <\/p>\n

\u00a0<\/p>\n

3. Cenu v\u011bcn\u00fdch b\u0159emen se opr\u00e1vn\u011bn\u00fd zavazuje uhradit nejd\u00e9le do ………………….. dn\u016f po pod\u00e1n\u00ed n\u00e1vrhu na vklad pr\u00e1v odpov\u00eddaj\u00edc\u00edch v\u011bcn\u00fdm b\u0159emen\u016fm na Katastr\u00e1ln\u00ed \u00fa\u0159ad, a to bankovn\u00edm p\u0159evodem na \u00fa\u010det povinn\u00e9ho veden\u00fd u \u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026, \u010d.\u00fa. \u2026\u2026\u2026\u2026\u2026\u2026.., variabiln\u00ed symbol \u2026\u2026..\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026..<\/p>\n

\u00a0<\/p>\n

4. Cena v\u011bcn\u00fdch b\u0159emen bude uhrazena na z\u00e1klad\u011b vystaven\u00e9 faktury, o kterou po\u017e\u00e1d\u00e1 opr\u00e1vn\u011bn\u00fd povinn\u00e9ho v\u010das. Pot\u00e9 m\u00e1 opr\u00e1vn\u011bn\u00fd mo\u017enost uhradit cenu v\u011bcn\u00fdch b\u0159emen v\u00a0n\u00e1hradn\u00edm term\u00ednu do dal\u0161\u00edch \u2026\u2026\u2026\u2026\u2026\u2026\u2026 dn\u016f po uplynut\u00ed lh\u016fty podle bodu 3. tohoto \u010dl\u00e1nku (d\u00e1le jen prodlou\u017een\u00e1 lh\u016fta).<\/p>\n

\u00a0<\/p>\n

5. Nebude-li ve lh\u016ft\u011b uveden\u00e9 v bodu 3. tohoto \u010dl\u00e1nku cena v\u011bcn\u00fdch b\u0159emen zaplacena je opr\u00e1vn\u011bn\u00fd povinen zaplatit povinn\u00e9mu smluvn\u00ed pokutu ve v\u00fd\u0161i \u2026\u2026\u2026\u2026\u2026. K\u010d za ka\u017ed\u00fd den prodlen\u00ed.<\/p>\n

\u00a0<\/p>\n

6. Pro p\u0159\u00edpad nezaplacen\u00ed ceny v\u011bcn\u00fdch b\u0159emen ani v prodlou\u017een\u00e9 lh\u016ft\u011b se sjedn\u00e1v\u00e1 smluvn\u00ed pokuta ve v\u00fd\u0161i \u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026. K\u010d za ka\u017ed\u00fd den prodlen\u00ed po uplynut\u00ed prodlou\u017een\u00e9 lh\u016fty.<\/p>\n

\u00a0<\/p>\n

7. Smluvn\u00ed pokuty jsou splatn\u00e9 na \u00fa\u010det povinn\u00e9ho specifikovan\u00fd v bodu 3. tohoto \u010dl\u00e1nku. Uplatn\u011bn\u00edm smluvn\u00edch pokut nezanik\u00e1 pr\u00e1vo povinn\u00e9ho na n\u00e1hradu \u0161kody.<\/p>\n

\u00a0<\/p>\n

IV.<\/p>\n

\u00a0<\/p>\n

1. Nebude-li ani v prodlou\u017een\u00e9 lh\u016ft\u011b sjednan\u00e1 cena v\u011bcn\u00fdch b\u0159emen uhrazena, m\u00e1 povinn\u00fd pr\u00e1vo od t\u00e9to smlouvy okam\u017eit\u011b odstoupit. T\u00edmto \u00fakonem se smlouva i v\u011bcn\u00e1 b\u0159emena ru\u0161\u00ed. Odstoupen\u00ed je \u00fa\u010dinn\u00e9 doru\u010den\u00edm tohoto p\u00edsemn\u00e9ho projevu v\u016fle opr\u00e1vn\u011bn\u00e9mu.<\/p>\n

\u00a0<\/p>\n

2. Povinn\u00fd m\u00e1 pr\u00e1vo v p\u0159\u00edpad\u011b odstoupen\u00ed od smlouvy um\u00edst\u011bn\u00e9 in\u017een\u00fdrsk\u00e9 s\u00edt\u011b odstranit a dot\u010den\u00e9 pozemky uv\u00e9st do p\u016fvodn\u00edho stavu nebo jejich odstran\u011bn\u00ed a uveden\u00ed do p\u016fvodn\u00edho stavu zajistit na n\u00e1klady opr\u00e1vn\u011bn\u00e9ho. Nezah\u00e1j\u00ed-li povinn\u00fd pr\u00e1ce k odstran\u011bn\u00ed in\u017een\u00fdrsk\u00fdch s\u00edt\u00ed do 30-ti dn\u016f od odstoupen\u00ed od t\u00e9to smlouvy je opr\u00e1vn\u011bn\u00fd pro tento p\u0159\u00edpad povinen um\u00edst\u011bn\u00e9 in\u017een\u00fdrsk\u00e9 s\u00edt\u011b z\u00a0dot\u010den\u00fdch pozemk\u016f odstranit a pozemky uv\u00e9st do p\u016fvodn\u00edho stavu na sv\u00e9 n\u00e1klady nejpozd\u011bji do 90-ti dn\u016f od \u00fa\u010dinku odstoupen\u00ed od smlouvy, pokud se smluvn\u00ed strany nedohodnou jinou smlouvou jinak. <\/p>\n

V.<\/p>\n

\u00a0<\/p>\n

1. Na z\u00e1klad\u011b t\u00e9to smlouvy lze v katastru nemovitost\u00ed zapsat na list vlastnictv\u00ed \u010d. \u2026\u2026\u2026\u2026\u2026\u2026.. pro katastr\u00e1ln\u00ed \u00fazem\u00ed \u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026., obec \u2026\u2026\u2026\u2026\u2026\u2026\u2026.., veden\u00fd u Katastr\u00e1ln\u00edho \u00fa\u0159adu pro \u2026\u2026\u2026\u2026\u2026\u2026\u2026., Katastr\u00e1ln\u00ed pracovi\u0161t\u011b \u2026\u2026\u2026\u2026\u2026\u2026\u2026.\u00a0 pr\u00e1va odpov\u00eddaj\u00edc\u00ed v\u011bcn\u00fdm b\u0159emen\u016fm ve prosp\u011bch vlastn\u00edka in\u017een\u00fdrsk\u00fdch s\u00edt\u00ed \u2013 \u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026.<\/p>\n

2. Povinn\u00fd a opr\u00e1vn\u011bn\u00fd vstoup\u00ed do pr\u00e1v odpov\u00eddaj\u00edc\u00edch v\u011bcn\u00fdm b\u0159emen\u016fm z t\u00e9to smlouvy vkladem pr\u00e1v v\u011bcn\u00fdch b\u0159emen dle t\u00e9to smlouvy do Katastru nemovitost\u00ed.<\/p>\n

\u00a0<\/p>\n

3. Opr\u00e1vn\u011bn\u00fd se zavazuje na sv\u016fj n\u00e1klad podat n\u00e1vrh na vklad do 3 pracovn\u00edch dn\u00ed po podpisu t\u00e9to smlouvy a jednu kopii n\u00e1vrhu na vklad opat\u0159enou origin\u00e1ln\u00edm podac\u00edm raz\u00edtkem a \u010d\u00edslem jednac\u00edm \u0159\u00edzen\u00edm se zavazuje opr\u00e1vn\u011bn\u00fd p\u0159edat bezodkladn\u011b povinn\u00e9mu.<\/p>\n

VI.<\/p>\n

\u00a0<\/p>\n

1. Platnost pr\u00e1vn\u00edho \u00fakonu v souladu s \u00a7 41 z\u00e1kona \u010d. 128\/2000 Sb., o obc\u00edch, dokl\u00e1d\u00e1 povinn\u00fd v\u00fdpisem z Usnesen\u00ed rady \u2026\u2026\u2026\u2026\u2026\u2026\u2026 \u010d. \u2026\u2026\u2026\u2026\u2026\u2026\u2026. ze dne\u2026\u2026\u2026\u2026\u2026\u2026., kter\u00fd tvo\u0159\u00ed p\u0159\u00edlohu \u2026\u2026\u2026\u2026\u2026\u2026 t\u00e9to smlouvy a jej\u00ed ned\u00edlnou sou\u010d\u00e1st.<\/p>\n

\u00a0<\/p>\n

2. Smluvn\u00ed strany prohla\u0161uj\u00ed, \u017ee tato smlouva byla seps\u00e1na podle jejich prav\u00e9 a svobodn\u00e9 v\u016fle. D\u00e1le prohla\u0161uj\u00ed, \u017ee jim je tato smlouva srozumiteln\u00e1 a \u017ee nebyla uzav\u0159en\u00e1 ani v\u00a0t\u00edsni ani za nev\u00fdhodn\u00fdch podm\u00ednek.<\/p>\n

\u00a0<\/p>\n

3. Z\u00e1stupci obou smluvn\u00edch stran prohla\u0161uj\u00ed, \u017ee jsou pln\u011b zp\u016fsobil\u00ed k pr\u00e1vn\u00edm \u00fakon\u016fm.<\/p>\n

\u00a0<\/p>\n

4. Tato smlouva zavazuje i pr\u00e1vn\u00ed n\u00e1stupce obou smluvn\u00edch stran.<\/p>\n

\u00a0<\/p>\n

5. Tato smlouva o z\u0159\u00edzen\u00ed v\u011bcn\u00fdch b\u0159emen nab\u00fdv\u00e1 platnosti i \u00fa\u010dinnosti dnem jej\u00edho podpisu ob\u011bma smluvn\u00edmi stranami. <\/p>\n

\u00a0<\/p>\n

6. Jak\u00e9koliv zm\u011bny t\u00e9to smlouvy lze prov\u00e1d\u011bt v\u00fdlu\u010dn\u011b p\u00edsemn\u011b ve form\u011b posloupn\u011b \u010d\u00edslovan\u00fdch dodatk\u016f k\u00a0t\u00e9to smlouv\u011b.<\/p>\n

\u00a0<\/p>\n

7. Tato smlouva o z\u0159\u00edzen\u00ed v\u011bcn\u00fdch b\u0159emen je vyhotovena v\u00a0sedmi stejnopisech s\u00a0t\u00edm, \u017ee \u010dty\u0159i stejnopisy budou p\u0159edlo\u017eeny p\u0159\u00edslu\u0161n\u00e9mu Katastr\u00e1ln\u00edmu \u00fa\u0159adu pro \u00fa\u010dely vkladu pr\u00e1v odpov\u00eddaj\u00edc\u00edch v\u011bcn\u00fdm b\u0159emen\u016fm do katastru nemovitost\u00ed, dva stejnopisy obdr\u017e\u00ed povinn\u00fd a jeden opr\u00e1vn\u011bn\u00fd.<\/p>\n

\u00a0<\/p>\n

8. V ostatn\u00edm se tento smluvn\u00ed vztah \u0159\u00edd\u00ed platn\u00fdm pr\u00e1vn\u00edm \u0159\u00e1dem \u010cR.<\/p>\n
