Stavebn\u00ed \u00fapravy spo\u010d\u00edvaj\u00edc\u00ed v modernizaci, rekonstrukci a oprav\u00e1ch spole\u010dn\u00fdch \u010d\u00e1st\u00ed domu, jimi\u017e se nem\u011bn\u00ed vnit\u0159n\u00ed uspo\u0159\u00e1d\u00e1n\u00ed domu a z\u00e1rove\u0148 velikost spoluvlastnick\u00fdch pod\u00edl\u016f na spole\u010dn\u00fdch \u010d\u00e1stech domu, zaji\u0161\u0165uje spole\u010denstv\u00ed se souhlasem nejm\u00e9n\u011b t\u0159\u00ed\u010dtvrtinov\u00e9 v\u011bt\u0161iny v\u0161ech \u010dlen\u016f spole\u010denstv\u00ed.<\/p>\n

(1)\u00a0V souladu s prohl\u00e1\u0161en\u00edm vlastn\u00edka budovy o osob\u011b pov\u011b\u0159en\u00e9 spr\u00e1vou domu (d\u00e1le jen \u201espr\u00e1vce\u201c), anebo v souladu s usnesen\u00edm shrom\u00e1\u017ed\u011bn\u00ed vlastn\u00edk\u016f jednotek (d\u00e1le jen \u201eshrom\u00e1\u017ed\u011bn\u00ed\u201c) o ustanoven\u00ed spr\u00e1vce, m\u016f\u017ee spole\u010denstv\u00ed zaji\u0161\u0165ovat provozn\u00ed, technick\u00e9, spr\u00e1vn\u00ed a obdobn\u00e9 \u010dinnosti spojen\u00e9 se spr\u00e1vou domu a pozemku a s dal\u0161\u00edmi \u010dinnostmi, pop\u0159\u00edpad\u011b n\u011bkter\u00e9 z t\u011bchto \u010dinnost\u00ed, na z\u00e1klad\u011b smlouvy se spr\u00e1vcem, kter\u00fdm m\u016f\u017ee b\u00fdt fyzick\u00e1 nebo pr\u00e1vnick\u00e1 osoba.<\/p>\n

(2)\u00a0Smlouva se spr\u00e1vcem obsahuje<\/p>\n

\u00a0\u00a0\u00a0\u00a0\u00a0a)\u00a0vymezen\u00ed \u010dinnost\u00ed, kter\u00e9 bude spr\u00e1vce vykon\u00e1vat,<\/p>\n

\u00a0\u00a0\u00a0\u00a0\u00a0b)\u00a0ur\u010den\u00ed zp\u016fsobu hospoda\u0159en\u00ed s p\u0159\u00edsp\u011bvky na spr\u00e1vu domu a pozemku a s finan\u010dn\u00edmi prost\u0159edky poskytovan\u00fdmi na \u00fahradu slu\u017eeb v\u010detn\u011b jejich evidence,<\/p>\n

\u00a0\u00a0\u00a0\u00a0\u00a0c)\u00a0povinnost spr\u00e1vce p\u0159edkl\u00e1dat j\u00edm uzav\u00edran\u00e9 smlouvy nebo jejich zm\u011bny p\u0159edem ke schv\u00e1len\u00ed org\u00e1nu spole\u010denstv\u00ed p\u0159\u00edslu\u0161n\u00e9mu podle t\u011bchto stanov, pokud byl spr\u00e1vce spole\u010denstv\u00edm zmocn\u011bn k jejich uzav\u00edr\u00e1n\u00ed,<\/p>\n

(10)\u00a0Shrom\u00e1\u017ed\u011bn\u00ed je schopn\u00e9 usn\u00e1\u0161en\u00ed, jsou-li p\u0159\u00edtomni \u010dlenov\u00e9 spole\u010denstv\u00ed, kte\u0159\u00ed maj\u00ed v\u011bt\u0161inu hlas\u016f. K p\u0159ijet\u00ed usnesen\u00ed je zapot\u0159eb\u00ed nadpolovi\u010dn\u00ed v\u011bt\u0161iny hlas\u016f p\u0159\u00edtomn\u00fdch \u010dlen\u016f spole\u010denstv\u00ed, pokud z\u00e1kon nebo tyto stanovy neur\u010duj\u00ed jinak.<\/p>\n

(11)\u00a0P\u0159i hlasov\u00e1n\u00ed je rozhoduj\u00edc\u00ed velikost spoluvlastnick\u00fdch pod\u00edl\u016f \u010dlen\u016f spole\u010denstv\u00ed na spole\u010dn\u00fdch \u010d\u00e1stech domu; \u010dlenov\u00e9 spole\u010denstv\u00ed, kte\u0159\u00ed jsou spoluvlastn\u00edky jednotky, maj\u00ed spole\u010dn\u011b jeden hlas.<\/p>\n

(12)\u00a0P\u0159i rovnosti hlas\u016f nebo nedos\u00e1hne-li se pot\u0159ebn\u00e9 v\u011bt\u0161iny nebo dohody, rozhodne na n\u00e1vrh kter\u00e9hokoliv \u010dlena spole\u010denstv\u00ed soud. Jde-li o d\u016fle\u017eitou z\u00e1le\u017eitost, m\u016f\u017ee p\u0159ehlasovan\u00fd \u010dlen spole\u010denstv\u00ed po\u017e\u00e1dat soud, aby o n\u00ed rozhodl. Pr\u00e1vo je nutno uplatnit u soudu do 6 m\u011bs\u00edc\u016f ode dne p\u0159ijet\u00ed rozhodnut\u00ed, jinak pr\u00e1vo zanikne.<\/p>\n

Ve smlouv\u011b m\u016f\u017ee spole\u010denstv\u00ed pov\u011b\u0159it spr\u00e1vce t\u00e9\u017e zaji\u0161\u0165ov\u00e1n\u00edm \u010dinnost\u00ed uveden\u00fdch v odstavci 1.<\/p>\n

(3)\u00a0Nabude-li spole\u010denstv\u00ed v\u011bci, pr\u00e1va, jin\u00e9 majetkov\u00e9 hodnoty, byty nebo nebytov\u00e9 prostory k \u00fa\u010del\u016fm uveden\u00fdm v z\u00e1kon\u011b o vlastnictv\u00ed byt\u016f a v t\u011bchto stanov\u00e1ch, je povinno s nimi hospoda\u0159it pouze v souladu s vymezen\u00fdm \u00fa\u010delem. V\u00fdbor nebo pov\u011b\u0159en\u00fd vlastn\u00edk m\u016f\u017ee v t\u011bchto z\u00e1le\u017eitostech \u010dinit pr\u00e1vn\u00ed \u00fakony pouze na z\u00e1klad\u011b usnesen\u00ed shrom\u00e1\u017ed\u011bn\u00ed, pokud v usnesen\u00ed shrom\u00e1\u017ed\u011bn\u00ed nen\u00ed stanoveno jinak.<\/p>\n

(4)\u00a0Spole\u010denstv\u00ed je povinno uplat\u0148ovat a vym\u00e1hat pln\u011bn\u00ed povinnost\u00ed ulo\u017een\u00fdch \u010dlen\u016fm spole\u010denstv\u00ed k tomu p\u0159\u00edslu\u0161n\u00fdm org\u00e1nem spole\u010denstv\u00ed a pln\u011bn\u00ed z\u00e1vazk\u016f t\u0159et\u00edch osob v\u016f\u010di spole\u010denstv\u00ed.
